NOVARTIS: Mi "amigo" Joe (Jimenez) no dijo todo...(III) y va preso.)

As much as Novartis might want the issue to go away, the company’s questionable $1.2 million consulting contract with President Donald Trump’s former attorney Michael Cohen caught the spotlight again on Wednesday as Cohen testified to Congress.

Pressed by lawmakers in the House of Representatives, Cohen sketched out a relationship that contradicts Novartis' original version in some important ways—namely, regarding how often the company interacted with Cohen and what, exactly, Novartis wanted him to do.

Cohen said Novartis hired him for his “knowledge of the enigma of Donald Trump,” according to a Huffington Post live feed, echoing Novartis' statements that it wanted insight into the future administration.

Cohen estimated he had interacted with the drugmaker six times—Novartis' initial account admits one meeting—and said the company initially wanted more than insight; it wanted influence.

Novartis “sent me their contract, which stated specifically that they wanted me to lobby," Cohen said, as quoted by Reuters. "That they wanted me to provide access to government, including the president."

“That paragraph was crossed out by me, initialed, and written in my own handwriting that says I will not lobby or do government relations work,” he added, the news service said.

During the hearing, Rep. Mark Meadows suggested Cohen may have violated lobbying laws with the deal. He didn't say whether Novartis might have run afoul of the rules. A Novartis spokesman on Wednesday said the company "previously addressed all questions regarding our relationship with Essential Consultants and we consider this matter closed."

Senate Democrats disputed Novartis' original account of the deal in a 22-page report last summer, saying ex-CEO Joe Jimenez had worked directly with Cohen several times and exchanged multiple emails with him. Their report offers statistics that back up Cohen's testimony Wednesday.

Ver:

Cohen and Jimenez "had at least four phone calls, and, between April and September 2017, exchanged multiple emails on substantive issues, including the Trump administration’s drug pricing proposals, Novartis’s potential investment in a small drug company backed by Columbus Nova, and with regard to opioid lawsuits," the report said.

Jimenez offered up some ideas on drug pricing that later showed up in the Trump administration's "blueprint" for lowering the cost of drugs, the report said.

Novartis had given the committee some documents showing its communications with Cohen, the Finance Committee report said. The company refused, however, to provide other documents the senators had requested, including "any documents reflecting internal communications regarding Mr. Cohen and his role with the company."

Senators challenge Novartis' account of Cohen deal, calling it 'longer and more detailed' than disclosed

After the Senate report, Novartis said it met with Cohen only once, citing internal documents it had submitted for the investigation. "As the documents we produced show, Novartis had one and only meeting with Mr. Cohen on March 1, 2017, and then concluded he was not able to provide the substantive consulting advice and insight for which he was hired," a company spokesman said in a statement provided to FiercePharma at the time. "We never asked Mr. Cohen to perform any services on our behalf after March 1, nor did he perform any."

Novartis further said the company had "additional communication" with Cohen when he initiated contact several times after the initial meeting.

Novartis and Cohen entered their consulting agreement back in early 2017 and the deal came to light last May thanks to attorney Michael Avenatti, who then represented adult actress Stormi Daniels. Avenatti said Novartis paid Essential Consultants, a company Cohen set up and also used to pay Daniels $130,000 to keep her quiet about an alleged sexual encounter with the president.

After Avenatti went public, Novartis opened up and said it had paid Cohen $100,000 a month for consulting. The company said it determined after one meeting that Cohen couldn't offer any help, but instead of canceling the deal immediately, it decided to make the remainder of the payments.

The company acknowledged it made a mistake in its July statement and said: "In hindsight—and certainly knowing everything we know now—we should have tried to terminate the contract with Mr. Cohen regardless of our views at the time of its legal enforceability."

The issue has served as an embarrassment for the company, and new CEO Vas Narasimhan has pledged to improve Novartis’ ethical standards and its standing in society. (Ver)

NOVARTIS: Mi "amigo" Joe (Jimenez) no dijo todo...(II) )

Novartis chose
to continue to pay Mr. Cohen
the full $1.2 million
rather than invoke
the contract clauses
that would have allowed them
to terminate payment
based on his
inadequate performance.

Introduction:
On May 8, 2018, press reports revealed that a shell company managed and controlled by Michael D. Cohen, former personal attorney to President Donald J. Trump and former executive vice president of the Trump Organization, had received payments totaling more than $4 million in the months following President Trump’s election in 2016.1 Mr. Cohen established the shell company, Essential Consultants LLC, in October 2016.

The allegations regarding Mr. Cohen were first disseminated via a memo released by Michael Avenatti, an attorney representing Stephanie Clifford, a pornographic film actress known as “Stormy Daniels.” Mr. Avenatti has said his client was paid $130,000 by Essential Consultants LLC shortly before the 2016 election to stay quiet about an alleged affair with Mr. Trump. According to the memo, “from October 2016 through January 2018,” Mr. Cohen engaged in “suspicious financial transactions totaling $4,425,033.46.”
Among them were payments from private equity firm Columbus Nova, an investment company with ties to sanctioned Russian oligarch Viktor Vekselberg; telecommunications company AT&T; Korea Aerospace Industries; and the Swiss pharmaceutical company Novartis.

Mr. Avenatti’s memo was widely reported, and press reports independently confirmed the information detailed in the memo.  On May 9, 2018, Novartis confirmed it made payments to Mr. Cohen totaling $1.2 million over the 12-month period ending in February 2018. Similarly,AT&T, Korea Aerospace, and Columbus Nova have all confirmed the payments to Mr. Cohen.

In response to the reports of these unusual payments to Mr. Cohen, several Senators began investigations into the payments made by Novartis to Mr. Cohen. Sen. Ron Wyden, in his capacity as Ranking Member of the Senate Committee on Finance, and Sen. Patty Murray, in her capacity as Ranking Member of the Committee on Health, Education, Labor, and Pensions, each wrote letters to Novartis on May 11, 2018.
The Senate Committee on Finance has jurisdiction over federal health programs under the Social Security Act, including Medicare and Medicaid, and participation in these programs account for a substantial portion of Novartis’s U.S. sales.
The Senate Committee on Health, Education, Labor, and Pensions has jurisdiction over most of the agencies, institutes, and programs of the Department of Health and Human Services (HHS), including the Food and Drug Administration (FDA) and its approval and oversight of pharmaceuticals manufactured by Novartis. Sen. Elizabeth Warren and Sen. Richard Blumenthal wrote jointly in their capacity as United States Senators on May 14, 2018.
Novartis provided the Senators with documents reflecting the company’s communication with Mr. Cohen, but declined to provide other documents requested by the Senators, including any documents reflecting internal communications regarding Mr. Cohen and his role with the company. A similar letter was sent to AT&T, which did not provide all of the requested information. While AT&T made a number of assertions about their relationship with Mr. Cohen and why he was hired, the company failed to provide any of the requested documents.

Findings:

  • 1. Novartis’s relationship with Michael Cohen was longer and more detailed than previously disclosed by the company.

  • 2. Novartis explicitly sought to hire Michael Cohen to provide the company “access to key policymakers” in the Trump administration. Novartis provided Mr. Cohen with drug pricing recommendations for “discussion with ... Trump administration” officials. Mr. Cohen represented that he would provide additional confidential information to Novartis.

  • 3. Documents reveal new details of ties between Michael Cohen and Columbus Nova – the private equity firm tied to sanctioned Russian billionaire Viktor Vekselberg – including an effort by Mr. Cohen to encourage Novartis to invest in a pharmaceutical company closely linked to Columbus Nova.

  • 4. Michael Cohen represented himself as Counsel to President Trump and the Trump Organization while arranging the agreement with Novartis and after it was signed.

  • 5. Novartis chose to continue to pay Michael Cohen even though the agreement gave Novartis the opportunity to terminate him for lack of “satisfactory performance.”

El amigo americano de Joe Jimenez...Michael Cohen.

Democrats are accusing a major pharmaceutical company of trying to influence the Trump administration's plan to lower drug prices.

Emails obtained by Democrats and publicly released Friday show that Novartis sent Michael Cohen, a former lawyer for President Trump, a list of proposals to lower drug prices.

Several of those proposals later appeared in the administration's "blue print" to lower drug prices.

In an email dated June 5, 2017, ex-Novartis CEO Joe Jimenez sent Cohen an email with a document attached called "drug pricing initiatives."

"Based on our conversation last week, I am forwarding you some ideas to lower drug costs in the US," Jimenez wrote.

Cohen responded a few hours later: "Received and I will forward to you their suggestions."

Several of the recommendations later ended up in the administration's blueprint, which was released in May. Those included proposals to speed up the approval of generic drugs and reforming the rebate system between pharmacy benefit managers and drug manufacturers.

Novartis previously acknowledged a $1.2 million agreement with Cohen last year. Cohen allegedly promised the company access to the Trump administration.

Novartis said it ended the relationship with Cohen in March 2017, but Democrats say new documents show communication continued until September.

"These documents indicate that Mr. Cohen and Mr. Jimenez – who was still the Novartis CEO at the time – had at least four phone calls, and, between April and September 2017, exchanged multiple emails on substantive issues, including the Trump administration’s drug pricing proposals, Novartis’s potential investment in a small drug company backed by Columbus Nova, and with regard to opioid lawsuits," according to the report.

Democrats have characterized the relationship as Cohen capitalizing on his ability to offer companies access to Trump administration officials.

Cohen's attorney Lanny Davis, a contributor to The Hill, said in a statement to ABC that Cohen provided "strategic advice" and did not "sell access."

Novartis spokesman Eric Althoff said Jimenez provided Cohen with a list of "well-known ideas for lowering the cost of pharmaceuticals that had been discussed publicly in the industry."

Althoff also said the company disagrees with the report's conclusion that Novartis misled the public about the extent of its engagement with Cohen.

"As the documents we produced show, Novartis had [its] one and only meeting with Mr. Cohen on March 1, 2017, and then concluded he was not able to provide the substantive consulting advice and insight for which he was hired. We never asked Mr. Cohen to perform any services on our behalf after March 1, nor did he perform any," he said. (Ver)

On May 11, 2018, Novartis issued a misleading public statement minimizing its relationship with Mr. Cohen.
Novartis stated that, on March 1, 2017, after signing the agreement with Mr. Cohen and meeting with him one time, company officials determined he would not be able to provide the anticipated services and “decided not to engage with him further.”

Mistakes were made. Joseph Jimenez, who served as chief executive of the Basel, Switzerland-based drug giant Novartis for eight years, says that he takes full responsibility for the company's decision to hire Michael Cohen, President Donald Trump's former lawyer, through a $1.2 million consulting agreement. But during a 15-minute interview, Jimenez grappled with exactly what went wrong and what he could have done differently. “I brought him into the company, so I would … we as a company were looking for people who could help us on policy,” Jimenez says when asked if the decision to hire Cohen was his. “I'm accountable for everything that happened so, yes. I'm accountable for everything that happened at Novartis over my eight years.”
Jimenez emphasizes that his successor, current Novartis chief executive Vas Narasimhan, was not involved in the decision to hire Cohen, and that Cohen never provided lobbying services or made introductions to other people in the Trump administration. Instead, he says, Cohen's contracting was handled by Novartis' legal team without the involvement of anyone who could have second-guessed the chief executive's decision to bring the former Trump Organization lawyer on board.(Más)

NOVARTIS Amistades peligrosas: Trump attorney Michael Cohen

“‘We made a mistake’ with Cohen payments.

as a consequence,

by a world that expects more from us,”
 Vasant Narasimhan. Novartis CEO

The CEO of Novartis apologized to employees for the company’s payments to President Donald Trump’s personal attorney Michael Cohen.

Novartis has garnered widespread criticism this week over the revelation that it paid Cohen $1.2 million in a yearlong contract in an attempt to gain insight into the Trump administration.

The drugmaker, along with other companies like AT&T, made payments to a Cohen shell company, Essential Consultants LLC, that was used for a hush payment to porn star Stormy Daniels shortly before the 2016 election.

Daniels’ attorney, Michael Avenatti, first revealed the nature of the payments.

“Personally and for my family, yesterday was also a difficult day, as unfounded stories spread through the US news. While I was not involved with any aspect of this situation, the facts did not matter. I went to sleep frustrated and tired,” Narasimhan wrote. “But I woke up this morning full of determination.”

He said he knew employees were likely “disappointed and frustrated.”

The arrangement was set up before Narasimhan took over as CEO in February. Novartis previously said it had met with Cohen only once but was bound to continue the payments.

NOVARTIS: "Lava la ropa sucia" con...Siemens / Klaus Moosmayer (II)

Ver anterior:

Struggling to shed a bad rep for a string of ethics scandals capped by the explosive accusations of several US Senators that company execs recently misrepresented the cozy relationship between former CEO Joe Jimenez and President Donald Trump’s personal attorney Michael Cohen, Novartis is once again looking to clean up its act.

CEO Vas Narasimhan has recruited a prominent German attorney to lead their ethics, risk and compliance efforts.

Klaus Moosmayer will now be charged with keeping the company clear of any new ethics scandals, which have come fast and frequently at the pharma giant. The lawyer has spent the past few years as chief compliance officer at Siemens and chairs the Anti-Corruption Taskforce of the Business and Industry Advisory Committee at the Organization for Economic Co-operation and Development.

Moosmayer is taking the place of Shannon Thyme Klinger, newly promoted to group general counsel in the wake of Felix Ehrat’s abrupt resignation during the crisis that hit Novartis as it struggled with revelations about their $1.2 million in payments to Cohen.

Novartis’ explanation — echoed by newly retired CEO Jimenez — was that this was a simple way to gain insights into Trump’s new administration and its healthcare policies. But some company insiders viewed it more like a simple way to pay for access.

A few weeks ago, a group of Democrats in the Senate released their own quick report, concluding that the company’s contention that top execs had only a brief, inconsequential exchange with Cohen and were forced to pay out the contract misrepresented the numerous contacts Jimenez had with Cohen.

“What he was selling was a line of access to the Trump administration,” said Sen. Ron Wyden in an interview with ABC News in July. “That would be how I would characterize it.” Wyden and his colleagues outlined numerous contacts Jimenez had with Cohen.

After initially bemoaning the need to do better in follow-up meetings with staff, Narasimhan and his top staff now insist that the whole issue is behind them.

The 600-pound gorilla, though, remains in the room, even if it’s not referred to in the company’s statement on its new hire.

Not helping much is that Novartis shook up its ethics and compliance operations last fall in the wake of kickback and bribery accusations. A Korean investigation determined company execs had been conducting a kickback scheme in that country while Novartis also faced corruption charges in Greece.

The chain of scandals has severely interrupted Narasimhan’s campaign to make over Novartis’ rep and present the company as a giant eager to do right by patients and healthcare systems, pursuing the latest in digital strategies to improve care.

“As we aspire to reimagine medicine, we must hold ourselves to (the) highest ethical standards and always aim to win and maintain the trust of society and our many stakeholders,” the CEO said in a statement. “Klaus has extensive experience in leading Compliance for large global organisations and is internationally recognized in his field.”
